In the 1860s, on the Paris-Marseilles and Paris-Lyon lines, Italian engineer Giovanni Caselli set up his “pantelegraph” - a real, albeit rudimentary facsimile machine. At roughly the same time, an experimental facsimile line was laid in Russia linking the imperial palaces in St. Petersburg and Moscow. The world’s first commercial telephone lines started humming a decade later, in 1877.

2. Think no one uses faxes? Think again!

Faxes may have gone out of fashion years ago, but they never went totally out of use: Go to the website of almost any large company or government agency, click the “Contact us” link, and you’re sure to see a fax number. That means somewhere in the bowels of the organization is an office with a fully functioning fax machine - even if it’s rather dusty. There might even be more than one.

3. Faxes are still really popular in Japan

7. To update the MFP firmware, you need to…print it

MFPs are primarily printers, and they operate along similar lines. Any commands given to the printer by the computer are processed as print jobs. This also applies to firmware updates - they too are sent as print jobs. Of course, this is not immediately obvious to the user, who just downloads a program that updates the firmware from the manufacturer’s website. But under the hood, that’s essentially what’s going on; the firmware is kind of “printed out.”

8. Fax machines can be used to hack a corporate network

At DEF CON 26, researchers Yaniv Balmas and Eyal Itkin presented a report playfully entitled “What the Fax?,” in which they demonstrated how to hack a fax machine through a telephone connection. The guinea pig in the study was a cheap MFP made by HP.

Although it took a while to study the MFP firmware, Balmas and Itkin eventually found a vulnerability in a device operating system module responsible for processing JPEG files received by fax. Using this vulnerability, they were able to gain full control over the MFP by means of an incoming fax. To demonstrate the potential consequences, the researchers used the EternalBlue exploit (well known after the WannaCry and NotPetya outbreaks) to infect a computer connected to the same network as the device.

The team duly notified HP of their findings. Fortunately, HP took the vulnerability seriously, assigned it “critical” status, and promptly released some patched firmware for susceptible devices.

Incidentally, the list includes about a hundred models, so if you use an MFP with a built-in fax machine manufactured by HP, we recommend that you take a look and, more likely than not, update its firmware. And while you’re at it, think about whether you actually still need such a stone-age means of communication. Perhaps it’s time to let go of the past?

TCPA Fax Class Action Doomed: Fax Number On Business Card Constitutes Consent

FCC Amerifactors Ruling: Junk Fax Class Actions™

On December 9, 2019, the Federal Communications Commission (“FCC”) issued a declaratory ruling In the Matter of Amerifactors Financial Group, LLC (“Amerifactors”) concluding that modern faxing technologies are not within the scope of the Telephone Consumer Protection Act (TCPA). The Amerifactors ruling, which follows the express language of the TCPA, determines that faxes received via an online fax service as electronic messages are effectively email and therefore are not faxes received on a “telephone facsimile machine” under the statute. This narrows the scope of the TCPA to traditional fax machines and will make it more difficult for attorneys to certify classes of fax recipients under the TCPA, ideally curbing the plethora of TCPA Fax class action lawsuits.

Amerifactors Background

In 2017, Amerifactors filed a petition for an expedited declaratory ruling asking the FCC to “clarify that faxes sent by “online fax services” are not faxes sent to “telephone facsimile machines”[1] therefore, outside of the scope of the TCPA. While faxing has declined in usage significantly, many of those who still receive faxes do so through cloud-based services that send the document via an attachment to an email. At the time of Amerifactors’ declaratory filing, they were defending a class action suit with claims that Amerifactors violated the TCPA by sending unsolicited fax messages, the bulk of which were sent to consumers from online fax services.

FCC Ruling and Logic

In the Amerifactors ruling, the FCC explained that faxes sent by online fax services do not lead to the “specific harms” Congress sought to address in the TCPA’s Junk Fax Protection Amendment and concluded that “a fax received by an online fax service as an electronic message is effectively an email.”

Unlike printed fax messages that require the recipient to supply paper and ink, the FCC concluded consumers can manage faxes sent by online fax services the same way they manage their email by blocking senders or deleting incoming messages without printing them, short-circuiting many of the specific harms envisioned by the original legislation. With online fax services, there is no phone-line that is occupied and therefore unavailable for other purposes, and no paper or ink used that must be supplied by the recipient. Second, it occupies the recipient’s facsimile machine so that it is unavailable for legitimate business messages while processing and printing the junk fax.”

In many ways, the FCC ruling in Amerifactors demonstrates FCC recognition of the changes in faxing technology. Steven Augustino of KelleyDrye[2], one of the attorneys who represented Amerifactors, points out that the language we use now does not match the technology that has largely replaced traditional faxing technology, instead offering a short-hand that has roots in an earlier era-and that references dead technologies. Augustino says:

“Amerifactors argued that the term “faxing” has outlived the actual technology of faxing, much in the same way that we still dial a telephone even though no one has a rotary telephone, or we “cc” people on emails but we aren’t using carbon copies. In many ways, saying ‘I sent a fax’ is similar to that, the term has outlived the technology that has supported it.”

There is reason to believe that this is the first of many declaratory rulings on fax matters under the TCPA. As of November 2019, there are thirty-six petitions in front of the FCC, and six of those petitions specifically address “junk” faxing rules. The declaratory ruling in Amerifactors and the FCC’s reasoning related to technological changes will likely impact the FCC’s rule-making on similar issues.

Implications for Future TCPA Fax Class Action Lawsuits

According to Douglas B. Brown of RumbergerKirk, one of the attorneys who represented Amerifactors in the FCC’s declaratory ruling:

“While the traditional fax machine has faded out of today’s business communications, online fax services provide secure communications that are critical to providing consumers with secure information about their finances, health and other important matters. The FCC’s ruling allows for these communications to continue without interference from debilitating class-action lawsuits.”

Per Samantha Duke of RumbergerKirk who also represented Amerifactors:

“First, according to the Hobbs Act, federal district courts are bound to enforce the FCC’s rules, regulations, and orders relating to the TCPA. Thus, this declaratory ruling may impact all fax class actions filed in the district courts in the country.”

The Amerifactors ruling requires a closer look at how faxes are being received complicating how class actions are certified under the TCPA. Per Duke:

“The Amerifactors ruling now makes the method by which the fax was received key to determining whether any particular unsolicited facsimile violates the TCPA. This individualized determination will most certainly complicate any attempt to certify a TCPA-fax class action as the question of whether the facsimile was sent to an Look at more info online fax service will predominate over any common issue.”

In short, unless a fax comes through an old-school fax machine, it’s outside the reach of the TCPA per the FCC’s Amerifactors ruling.

Why Do People Still Use Fax Machines?™

The fax machine is a symbol of obsolete technology long superseded by computer networks-but faxing is actually growing in popularity.

Four years ago, I wrote a history of 160 years of faxing, saying my book covered “the rise and fall of the fax machine.” The end I predicted has not yet come: Millions of people, businesses, and community groups send millions of faxed pages every day, from standalone fax machines, multifunction printers, and computer-based fax services. It turns out that in many cases, faxing is more secure, easier to use, and better suited to existing work habits than computer-based messaging.

Faxing remains alive and well, especially in Japan and Germany-and in major sectors of the US economy, such as health care and financial services. Countless emails flash back and forth, but millions of faxes travel the world daily too.

A worldwide survey in 2017 found that of 200 large firms, defined as companies with more than 500 employees, 82% had seen workers send the same number of, or even more, faxes that year than in 2016. A March 2017 unscientific survey of 1,513 members of an online forum for information technology professionals found that 89% of them still sent faxes.

The persistence of faxing-and the people who send faxes-is in part because the fax industry has adapted to accommodate new technologies. Fax machines still dominate, but both surveys suggested users were shifting to computer-based services, such as fax servers that let users send and receive faxes as electronic documents. Cloud-based fax services, which treat faxes as images or PDF files attached to emails, are also becoming more popular. These new systems can transmit faxes over telephone lines or the internet, depending on the recipient, handling paper and electronic documents equally easily.

Fax’s longevity also benefits greatly from reluctance-both legal and social-to accept email as secure and an emailed electronic signature as valid. Faxed signatures became legally accepted in the late 1980s and early 1990s in a series of legal and administrative decisions by state and federal agencies. The Electronic Signatures Act in 2000 also gave digital signatures legal power but institutional and individual acceptance followed only slowly-if at all.

Even parts of the federal government preferred faxes over email for many years thereafter. Not until 2010 did the Drug Enforcement Agency allow electronic signatures for Schedule II drugs like Ritalin and opiates, which comprised about 10% of all prescriptions. That meant a pharmacist could accept a faxed prescription but not one scanned and sent by email.

Another reason faxing hangs on is because competing technologies are weak. The health care industry generates huge amounts of data for each patient. That should make it fertile ground for a fully digital record-keeping system, “where data can flow easily between patient, provider, caregivers, researchers, innovators, and payers,” as Seema Verna, the head of the Centers for Medicare and Medicaid Services, put it in a speech earlier this year.

Federal privacy laws and deliberately incompatible standards, however, stand in the way. Immediately after the passage of the 1996 Health Insurance Portability and Accountability Act, fax vendors retooled their transmission, reception, and storage systems and procedures to protect patients’ personal records. Specifically, HIPAA-compliant fax systems ensure the correct number is dialed and limit who can see received faxes. Digital patient-information systems have struggled to meet the same standards of administrative, technical, and physical security.

The Obama administration spent more than $25 billion encouraging doctors and hospitals to adopt electronic medical records systems. Crucially, rather than forcing competing systems to be compatible in order to receive federal support, the administration believed the market would decide on a standard to communicate.

What actually happened was that competing companies deliberately created incompatible systems. Doctors’ offices and hospitals that use different records databases can’t communicate with each other digitally-but they can via fax. For many medical professionals, particularly independent physicians, faxing is far easier than dealing with expensive, hard-to-use software that doesn’t actually do what it was supposed to: securely share patient information.

Absent a compelling reason or some management or government mandate, people often don’t change technologies. This is true beyond faxing: I drive a 2005 Camry. There are plenty of cars that are better in some way-safer, more fuel-efficient, more comfortable-but so long as the Camry passes state inspections and performs adequately, I can avoid the challenges and costs of buying a new car and learning how to use its new Send fax from computer for free features.

Not surprisingly, a recent survey found that Britain’s National Health Service operated more than 8,000 fax machines. In response, the UK’s Secretary of State for Health and Social Care Matt Hancock labeled faxing a symbol of the National Health Service’s technological backwardness and pledged to introduce new technologies more quickly. In December, the National Health Service decided to stop buying fax machines in 2019 and end their use by the end of 2020. That’s the same goal the Centers for Medicare and Medicaid Services’ Verna has for American doctors to stop faxing.

Nevertheless, faxing continues because it remains better-cheaper, more convenient, more secure, more comfortable-than the alternatives for many people, businesses, and organizations. Faxing will remain important until transmitting digital data becomes easier and more accepted. That could be a long way off, though. US federal initiatives are trying to make medical records systems more compatible, but no one has yet been hired to take a key leadership position at CMS.

In an April 17, 2020 post to the Liskow Energy Law Blog, we advised our clients and friends that the Internal Revenue Service (“IRS”) had published guidance on how refunds attributable to the CARES Act newly-permitted 5-year carryback of NOLs in section 172 of the Internal Revenue Code (the “Code”) and the accelerated use of AMT Carryforward Credits in section 53(e) of the Code can be obtained. See, J. Bradford, New IRS Guidance on Obtaining Refunds for Net Operating Loss Carrybacks, Corporate AMT Carryforward Credits and Filing Amended Returns for Partnerships (the “Prior Blog Post”).[1] Since that time, the IRS has published on its website additional guidance in the form of frequently-asked questions and responses (“FAQs”) regarding the implementation of the temporary policy allowing (1) corporations to file by fax Form 1139 - Corporation Application for Tentative Refund (“Form 1139”) to obtain a tentative refund for a prior tax year to which an NOL is carried back pursuant to the new NOL carryback rules and to obtain a tentative refund attributable to implementing the new accelerated use of AMT Carryforward Credits and (2) individuals to file by fax Form 1045 - Application for Tentative Refund (“Form 1045”) to obtain a tentative refund for a prior tax year to which an NOL is carried back.[2]

FAQs began appearing on its website on April 14, 2020, when the IRS announced the temporary policy allowing filing by fax beginning on April 17, 2020 and the appropriate fax numbers for corporations ((844) 249-6236) and individuals ((844) 249-6237) to use. Additional FAQs have been added since that date, and several have been updated. Taxpayers with specific questions should consult the IRS website for the detailed FAQs. However, a summary of the key points in those FAQs is set out below:

FAQ 1 - The temporary procedure of allowing filing by fax is added to accelerate certain relief provided in the CARES Act.

FAQ 2 - A taxpayer who previously mailed in either Form 1139 or Form 1045 can submit such form again by faxing it to the appropriate number.

FAQ 3 - Forms 1039 and 1045 will be processed in the order in which they are received.

FAQ 4 - Any Form 1039 or Form 1045 that is deemed an ineligible claim for refund that should have been filed on Form 1120-X - Amended U.S. Corporation Income Tax Return (“Form 1120-X”) or Form 1040-X - Amended U.S. Individual Income Tax Return (“Form 1040-X”) will be processed when normal IRS operations resume.

FAQ 5 - With changes in the law brought about by the CARES Act, Form 1139 and Form 1045 now can be used to apply for a refund carried back to a section 965 year.[3] Instructions on those forms to the contrary should be disregarded. Updated forms to be issued are expected to reflect the changes in the law.

FAQ 6 - The temporary filing by fax does not apply to the filing of Form 4466 - Corporate Application for Quick Refund of Overpayment of Estimated Tax. The filing of this form continues in accordance with existing instructions.

FAQ 7 - The temporary policy of allowing filing by fax for Forms 1139 and 1045 will not be made permanent.

FAQ 8 - The temporary filing by fax does not apply to the filing of Form 1120-X or Form 1040-X. The filing of these amended return forms continues in accordance with existing instructions.

FAQ 9 - Forms 1139 and 1045 need to reflect the numbers in the originally filed or previously processed amended returns. If a Form 1120-X or Form 1040-X has been filed and the revised numbers are used in Form 1139 or Form 1045, the amended return will have to be processed prior to processing Form 1139 or Form 1045. Taxpayers should not fax amended returns when Form 1139 or Form 1045 is filed by fax.

FAQ 10- Detailed instructions are provided on how to prepare Form 1139 and Form 8827 to claim a tentative refund for AMT Carryforward Credits, since prior to the CARES Act Form 1139 could not be used for this purpose.

FAQ 11 - A taxpayer’s application for a refund based on an NOL carryback and on an accelerated use of AMT Credit Carryforwards can fax online live chat support be made on a single Form 1139. Detailed instructions on preparing Form 1139 and Form 8827 are provided.

FAQ 12 - Detailed instructions are provided as to what documents should be included along with Form 1139 filed by fax.

FAQ 13 - Taxpayers filing Form 1139 or Form 1045 will be contacted by the IRS by telephone if more information is needed. Make sure the appropriate phone numbers are included on these forms.

FAQ 14 - Taxpayers currently under examination should not provide Form 1139 or Form 1045 directly to the examining agent. Instead, the forms should be filed via the normal process or the temporary procedures for filing by fax.

FAQ 15 - Taxpayers needing to file an amended return on Form 1120-X or Form 1040-X in order to then file an application for a tentative refund should file hard copies of the amended return by mail in order to meet the filing deadlines for such amended returns.

FAQ 16 - A corporate taxpayer that files an amended return on Form 1120-X electronically can file Form 1139 using the figures as included in the amended return. Such a taxpayer is instructed to notate on the fax cover page that it e-filed Form 1120-X and the dates that the e-filing was accepted. IRS will not process the taxpayer’s Form 1139 until the figures in the amended return or processed and reflected in the taxpayer’s account.

FAQ 17 - IRS is working diligently to process all Forms 1139 and Forms 1045 within the statutorily-required 90 day timeframe.

FAQ 18 - The temporary procedures for filing Forms 1139 and 1045 by fax may not be used to file a Form 1139 or Form 1045 associated with a previously-filed Form 990-T (Exempt Organization Business Income Tax Return). Instead, an exempt organization must file an amended Form 990-T in accordance with the Instructions for Form 990-T and may attach a Form 1139 or Form 1045 to the amended Form 990-T.

With no journalists or fans from South Korea allowed to cross the 38th parallel, the blackout has government and Korea Football Association (KFA) officials scrambling to find a method to keep media and supporters updated -- a tricky mission, given the almost total lack of communication between the two countries.

"We are still thinking of what would be the best way to deliver the news," an official from South Korea's Unification Ministry said in a media briefing in Seoul on Monday.

"We will review available means to deliver as much information as quickly as possible."

With doubts about the internet connection at the stadium added to the fact that North Korea does not allow access to much of the worldwide web -- including Kakao Talk, South Korea's most popular messaging service -- sending faxes from Pyongyang to government offices in Seoul has been identified as the likeliest option. These would then be distributed to the various media outlets.

Communication is not the only challenge awaiting South Korea. A request from the KFA for the 25-man squad to make the 121-mile (195-kilometre) journey between Seoul and Pyongyang by bus or direct flight was ignored by its North Korean counterpart. Players and officials have travelled via Beijing, where they have been told to leave their mobile phones.

The Taeguk Warriors will have just one training session on the artificial grass of the Kim Il Sung stadium on Monday evening and will return to Seoul on Wednesday.
